Misuse of this bill


How are we going to handle misuse of this law? What if corrupt people gang up together and implicate an honest government official?

Shouldnt we have a clause for anybody who is misusing the law ?

Recommended Solution: Any complaint should be thoroughly investigated and ensured that the complainant does not have any pending investigation against him / her.

Any law can be misused, for that matter. That is why the law-enforcement agencies should not be under the aegis of the executive. It should be under the judiciary.

It would be very difficult so because under Jan Lokpal, Lokpal committee selection procedure is very transparent and left almost no scope of inclusion of incompetent and dishonest people. Selection will be recorded and selection panel is constituted of civil society, CJIs and High Court judges and last two Magsaysay Award Winners.

Against all odds, if one case out of 1000 case happen to be in-genuine, then that is what a cost one country must take in order to remove the cancer of corruption. Statistically speaking, one may take a significance level of 0.001. You can't expect the six-sigma being implemented in such subjective matter's of practical life. After all India has been able able to produce just one six-sigma organization. Neither our current system assures that honest can't be entangled by dishonest conspirators.

The fear of misuse mustn't deter us from using it. There are enough checks and balances provided in the draft that is proposed by the civil society. Misuses, if any, should serve as learning and rectifying tools. If there is desire to succeed, talks of misuse cannot unnerve us and should not unnerve us. We have embarked on a good cause. There will be impediments, road blocks and vested interests. Many will rise from nowhere and raise questions that never haunted them in the past. They were quite happy with the situation that was obtaining in the country. Now that Anna Hazare has achieved something they had not seen it happening in the wildest of their dreams, they are uncomfortable. One thing is sure, the proposed Lokpal and Lokayukta bills will rob many of their sleep. Therefore, a large number of them have risen from their slumber to advise Anna and find fault with his methodology. As if he is the first person in the world to have practised it. They have very conveniently forgotten Mahatma Gandhi and his Satyagraha. Such people should keep their counsel to themselves. Anna Hazare is after all a normal human being who can have personal views on certain matters or individuals and he is within his rights to state his approval or disapproval of certain individuals. Just because his praise for someone does not suit someone else, it does not mean he should refrain from stating them. Besides, a progressive person is he who is amenable to change. Who can tell he will not change his opinion on various individuals or events. Time is the best teacher.

Just thought of worthwhile mentioning it, not only the methodology, but some section of media and people have started questioning Anna Hazare ji credibility and linking him with some kind of conspiracy of even Sangh Parivar. I am happen to be a member of one Facebook group on Jan Lokpal, and i was amazed to read the posting there. One member questioned about his intent behind praising Narendra Modi and allegdely Raj Thakrey. Today, i somehow read two columns, First column in Business Standard by Sanjay Baru, former Media Advisor of Manmohan Singh and editor of Business Standard and 2nd in Economic Times editorial page by C.L. Manoj, amazingly, both sought to downplay this movement and criticized it. The one question which my mind couldn't resist was, "Is it just a conincidence that leading two business newspaper are coming heavily on Anna HAzare? God knows the answer, however, Having seen the collusion and nexus of Corporates, Politicians and Babus, through Radia tape leaks, it is not improbable that corporates start paying media for hate-mongering against Anna Hazare ji. Even Jan Lokpal have the potential to shut the door for many of so called Policy Research Firms, which were lobbying for a particular kind of policy to suit their patronage company. And, i envisage that these kind of policy research firms, with their vested interest, will try their level best to defame Anna Hazare ji to vandalize this movement.

So summarily, extent of entrenchment of society belief on Anna Hazare and briagade will define the success of this movement.

There will be a media campaign to downplay Anna Hazare's efforts. It is no coincidence or chance - there is a concerted effort on to basically divert peoples' attention from thie crusade against corruption - keep an eye on all english new channels.

We definitely should not deter from framing this law. However, the most mis-used laws according to the Indian judiciary survey: "attempt to Murder", "Dowry Harassment", etc. were also framed without any checks and balances and the misuse has reached very significant levels. Government is now finding it hard to bring in amendments to curb the misuse.

Added to this even the perjury laws are extremely weak.

However, I do not want to get into a parallel discussion, but I would like to point that we should put checkpoints now rather than later. After a lot of effort Annaji and party has been able to convince government to constitute a "friendly" committee to draft a good bill. It would take the same amount of effort to make amendments. Its better to get things right ( or even very close to right) the first time rather than wait for "Next time".

I can clearly see that the corrupt people ganging up together and implicating the rare "honest officers", Lets encourage honesty rather than misuse.

Bros, Every single act of govt. is transparent with the JAN LOKPAL BILL and any misuse or misdeed will come under scanner of 1.21 Billion of Indian's and none, will take it lightly. So, Don't Scare of any Negative's.. We are Not going To Spare any Negativity From Now On.. Our First Aim is to Seek Jan Lokpal Bill Get Passed in Parliament without any Hurdle's and Delay's. If it Get's Passed.. These People(MP's) Are Liable For Their Act's & Answerable to The General Public of India For Their Misdeed's.

chairPerson for LokPal Commite.

Ex-Chief Justice of Supreme court ,also had been under corruption shadow ,Immedietly when out of that post. . In this context am worried how we can keep that as qualification for the chairPerson for LokPal Commite.
