Heights of cheating by builders


I want to bring your kind attention towards the harassment faced by common citizen of the country by the powerful so called reputed builders. Like any other middle class office going family, My wife and I had a dream of owning our own house. With our limited resources, in August,2007 we booked a flat with a builder M/S MVL Limited in their residential society MVL CORAL, Bhiwadi, District Alwar Rajasthan. Original site layout plan of the society has been attached with the message. Society had 5 avenues. Our booking details are: Flat no. 506 at Avenue no. 3, Wing A on 5th floor.
As per builder buyer agreement possession of the flat was to be given within 36 months i.e. in August,2010. Inspite of lapse of more than 5 years after the date of booking, MVL has failed to provide the possession of the said flat. MVL has changed the avenue numbers and site layout plan without any prior information. New site layout as per which construction is going on has also been attached with this message.
We came to know they have not got the necessary approvals for the revised layout from Urban Improvement Trust(UIT) Bhiwadi. They have mentioned covered parking at stilt level in Builder Buyer Agreement for which they have already taken money from us. But now they have changed all stilt level floors to apartments and there is no provision for covered car parking. All the construction activities going on at the site is illegal. We also came to know from reliable sources that they have offered bribe to top officials of UIT Bhiwadi to get their new layout plans approved. Please have a look on attached layout plan. If ever they will give possession(doubtful), we will be offered flat in Avenue 3(Original Avenue 2) which has been blocked from eastern side by revised layout of avenue 4(original avenue 1). We have paid 90% of the total construction linked payment. After getting major chunk of money from us, they have stopped construction activities in avenue 2 and 3. Now they are concentrating on avenue 4(original avenue 1). Even they have changed the layout of Avenue 4(original avenue1) to allure the new buyers. We are suffering from severe mental agony because of it. We shall be highly obliged if you could intervene and highlight this issue.

We are a group of buyers who bought apartments together in victoryone projects in Noida extension. It has been a very bad experience since beginning. After U P Apartments act came into force, we have asked builder to provide details of super/carpet area calculation and construction quality details - but in spite of multiple reminders they haven’t shared any details. This indicates that they are cheating in Super Area/Carpet Area calculation and may be using substandard quality of material. This poses risk to lives of our families and dear ones. We are planning to file a complaint with GNIDA under U P Apartment Act.
