Thumbs up Anti-Corruption Bureau - Ameerpet Land Case


The Anti-Corruption Bureau (ACB) on Wednesday registered cases against former chief minister K Rosaiah and others in connection with handing over nine acres of government land worth Rs 200 crore to a private party when Rosaiah was the chief minister. It was on the directions of the Andhra Pradesh High Court that the ACB registered cases yesterday and took up investigation.

The ACB has registered cases against Rosaiah and 16 others under Sections 11, 12 and 13 of the Prevention of Corruption Act besides 406 IPC, 409 IPC and 420 IPC read with 120 B.

Sources told Express that the ACB would be gathering all relevant files from various departments in the next couple of days. Once they seize the records, it is likely that the ACB officials may question the former chief minister and some bureaucrats as well. A petition was filed in the ACB court by an advocate Mohanlal in December last year, stating that the former chief minister and some officials illegally got a GO issued regularising occupation of a prime land in Ameerpet. The petitioner complained that rules were flouted for extraneous considerations for a land extending 9 acres and 14 guntas located in survey numbers 26, 30, 41, 42 and 44. The land is located near Mythrivanam at Ameerpet.

The petitioner even cited various judgments of the Supreme Court to contend that once the government takes into possession a piece of land and pays compensation, it has no power to withdraw from the land acquisition proceedings. He pointed out that the land was under the possession of HMDA (then HUDA) since May 10, 2004 and no provision of land acquisition Act allowed the government to re-allot it.

Nearly 14 persons made representations to the government in 2004, 2005 and 2006 seeking the land but their appeal was rejected. However, a similar appeal was made during Rosaiah’s tenure and got a decision in their favour.

While directing the ACB to register cases against Rosaiah and others and investigate the matter, the court said that the accused may not be arrested.
