Red face trasnfer posting corruption in CBEC, Finance ministry

Reg; Placement of Sh. Neeraj Kansal in violation of Transfer Policy (IRS Group-A) officers, CBEC

Respected Sir,

On 18.01.2008, a Transfer/ Placement Policy in respect of Group ’A’ officers of IRS(C&CE) was issued (amended from time to time).

As per its Para 5.3, the entire duration in one Zone shall not be more than 14 years and the entire duration of tenure in Class ‘A’ station shall be maximum 8 years. As per Para 5.6, the entire tenure at Class ‘A’ stations shall not exceed 16 years. The only exception is in Para 2.5 i.e. ‘public interest’ and ‘administrative exigency’.

Shri Neeraj Kansal (IRS-1994 C&CE), joined service on 01.06.1995 and has been in North Zone since then and is in Delhi since 28.06.1998 to till date except to be on deputation from 01.06.2007 to 16.05.2013, that also at Delhi. Still on 06.01.2015, he has been posted as Commissioner (Customs), Delhi itself despite the fact that he has completed 8 year in Delhi a Class ‘A’ city, 14 years in one Zone and even 16 years in Class ‘A’ city in total.

In terms of the Transfer Policy, Shri Neeraj Kansal ought to have been transferred outside North Zone and Class ‘A’ cities. Whereas in gross violation of the Policy, on his promotion to the rank of Commissioner he has been retained at Delhi itself without assigning any reasons in the Transfer/ posting orders dated 06.01.2015. Hence his retention at Delhi itself is vitiated on account of specific aforesaid violations of the Transfer/ placement Policy. Since he has come back to cadre from deputation and on promotion, there cannot be any govt. exigencies and/ or public interest to retain him in Delhi.

This is not only defeats the very purpose of the Govt. Policy, but demoralise the other eligible officers to render their services at Delhi, who now stands ignored. Such action will not inspire public confidence and faith and as well as vitiates the Govt policies.
